1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of mallbyimaze.com (“the Platform”), operated by I-Maze LLC, a United States-based limited liability company (“we,” “us,” or “Company”). By visiting, registering on, or transacting through the Platform, you (“User,” “Buyer,” or “Seller”) agree to these Terms in full. If you do not agree, you must not use the Platform. These Terms apply to all users of the Platform, including buyers, sellers, and visitors.

2. About the Platform

Mall by Imaze is an international multi-vendor eCommerce marketplace that enables independent sellers to list and sell products to buyers worldwide. The Platform uses the Imaze 3PL API (hosted at 3pl.imazeonline.com) to provide real-time shipping rate calculations for orders based on the following parameters provided by the seller or buyer:

• Box weight
• Box height, length, and width (dimensions)
• Destination ZIP code or postal code
• Origin location (USA)

Shipping rates are calculated for both domestic (within the USA) and international destinations. I-Maze LLC acts as a marketplace facilitator and third-party logistics (3PL) provider. We are not the manufacturer or direct seller of products listed by third-party sellers on the Platform.

3. Eligibility

You must be at least 18 years of age to use mallbyimaze.com. By using the Platform, you represent and warrant that you are 18 or older, have the legal capacity to enter into a binding agreement, and are not barred from using the Platform under any applicable law. If you are registering as a business seller, you further represent that you have the authority to bind that business to these Terms.

4. User Accounts

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Notify us immediately at [email protected] of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, illegal, or abusive behavior.

5. Seller Accounts & Obligations

Sellers on mallbyimaze.com must:

• Complete the seller registration process and provide all required business and identity documentation.
• List only products that they legally own, are authorized to sell, and are compliant with US and international trade laws.
• Accurately describe all products, including condition, specifications, and country of origin.
• Provide correct package dimensions (weight, height, length, width) required for accurate shipping rate calculation via the Imaze 3PL API.
• Fulfill orders promptly and in accordance with the shipping timelines displayed to buyers.
• Comply with all applicable US federal and state laws, including consumer protection, tax, and export regulations.
• Provide accurate tax information (e.g., W-9 form for US sellers) as required by law.

I-Maze LLC reserves the right to remove any seller listing or suspend any seller account that violates these obligations without prior notice.

6. Buying on the Platform

When you place an order on mallbyimaze.com, you are entering into a purchase agreement directly with the seller. I-Maze LLC facilitates the transaction but is not a party to the sale contract between buyer and seller. As a buyer you agree to:

• Provide accurate shipping information, including delivery address and ZIP/postal code, for correct shipping rate computation.
• Pay the full order total, including product price and applicable shipping fees, at the time of checkout.
• Review the product listing, seller information, and shipping rates carefully before completing your purchase.

7. Shipping Rates & 3PL API

All shipping rates displayed on mallbyimaze.com are calculated in real time using the Imaze 3PL API (3pl.imazeonline.com), based on the box dimensions (weight, height, length, width) and destination ZIP/postal code entered by the seller or buyer. You acknowledge that:

• Shipping rates are estimates provided at the time of checkout and are based on the information supplied. Inaccurate dimensions or destination data may result in rate discrepancies.
• Displayed rates are for standard carrier services. Customs duties, import taxes, and other international fees are not included in the shipping rate and are the sole responsibility of the buyer.
• Shipping timelines are estimates and may be affected by carrier delays, customs clearance, or other factors outside our control.
• I-Maze LLC is not liable for delays, losses, or damages occurring during shipment once a package has been handed to the carrier.

8. No Refund Policy

By completing a purchase on mallbyimaze.com, you expressly agree that:

• No refunds will be issued for any product purchases, shipping fees, or service charges once payment is confirmed.
• Shipping fees calculated and charged via the Imaze 3PL API are non-refundable once a shipment is booked or dispatched, regardless of delivery outcome.
• I-Maze LLC and mallbyimaze.com do not process refunds on behalf of sellers. Any disputes regarding product quality, non-delivery, or order discrepancies must be raised directly with the seller through the Platform’s messaging system.
• In the event a seller agrees to a refund or replacement, such arrangement is solely between the buyer and seller. I-Maze LLC is not responsible for facilitating, guaranteeing, or enforcing such arrangements.
• Chargebacks initiated without prior contact and good-faith resolution attempt with the seller through our Platform may result in account suspension.

This no-refund policy applies to all users globally and is a material term of your use of mallbyimaze.com.

9. Prohibited Activities

Users may not:

• List, sell, or purchase counterfeit, stolen, illegal, or prohibited goods.
• Attempt to circumvent, hack, or interfere with the Platform or the Imaze 3PL API.
• Use automated tools (bots, scrapers) to access or extract data from the Platform without written permission.
• Misrepresent product details, shipping dimensions, or personal identity.
• Engage in fraudulent transactions, money laundering, or any illegal financial activity.
• Harass, threaten, or abuse other users, sellers, or Platform staff.
• Violate any US federal, state, or local law or any applicable international law in connection with your use of the Platform.

Violations may result in immediate account termination, removal of listings, and referral to law enforcement authorities.

10. Intellectual Property

All content on mallbyimaze.com, including but not limited to logos, trademarks, website design, text, graphics, and software, is the property of I-Maze LLC or its licensors and is protected by US copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our express written consent. Sellers retain ownership of their own product images and descriptions but grant I-Maze LLC a non-exclusive license to display such content on the Platform.

11. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES, INCLUDING THE IMAZE 3PL API SHIPPING RATE CALCULATIONS, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I-MAZE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF MALLBYIMAZE.COM, THE IMAZE 3PL API, OR ANY TRANSACTIONS ON THE PLATFORM. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO I-MAZE LLC IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless I-Maze LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any products you list or sell on the Platform.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States of America and the state in which I-Maze LLC is registered, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of mallbyimaze.com shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), and the arbitration shall take place in the United States. You waive any right to a jury trial or class-action lawsuit in connection with any dispute under these Terms.

15. Privacy

Your use of mallbyimaze.com is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

17. Termination

We may suspend or terminate your access to mallbyimaze.com at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, the Platform, or third parties, or for any other reason. Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination (including no-refund policy, limitation of liability, indemnification, and governing law) shall survive.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
